My name is Greg Stoner, and I am the Managing Attorney of The Property Rights Law Firm. I completed my Law degree in 1995 and I have been involved in litigation (trial) cases since that time. I pride myself in having an up-to-date understanding of the current status of the Florida Condominium Law and the Federal Interstate Land Sales Full Disclosure Act. Additionally, my experience in litigating these type of cases are rivaled by only a few.
With regard to cases involving Maesbury Homes, Inc; Lake Austin Properties I, Ltd.; and/or related companies., my fee is 25% of any recovery and if no recovery then you owe me nothing. If we make a recovery you may also owe costs, most likely in the range of $500 to a maximum of $750 (for court filing fees, service of process, copies, postage, etc.). However, costs in some of these cases have been as low as approximately $100.00. Additionally, there are no up-front fees or costs to have me represent you in these matters. If we do not make a recovery for you then you do not owe my firm any money. When other law firms charge higher rates and ask for up-front money, you need to ask yourself “why?” I am very confident in the work I perform and the job that I do; therefore, I do not require any up-front fees or costs. Additionally, because of the large number of clients that I represent in these matters, I am able to charge a percentage fee much lower than other law firms (25% vs. 33%). If there is no recovery then you do not owe me even a single penny.
I have handled these cases in both Federal and State Court. The specific facts of your case will result in what Court that I file the lawsuit. Some law firms claim that filing only in Federal Court is the way to go. However, I don’t believe that a strict rule applies to all cases. With regards to some issues the State Courts have been more favorable; with regard to other issues the Federal Courts have been more favorable. Clearly, depending on the case, there are advantages and disadvantages to filing in State or Federal Court. There should never be a one-size fits all approach to these cases. I represent you and I will discuss the options involved in your case with you, and then you can make the decision of what Court your case is filed. Just because one-way of filing a case is more favorable for the law firm should not be the reason that all of their cases are filed in Federal Court. I advise my clients of the issues involved in their case, so that they can make informed decisions in their individual best interest.
